Purpose of Agreement

This agreement sets out the terms under which Easi-Sell Cars on Consignment (“Easi-Sell”) provides display space and facilitates the private sale of the owner’s vehicle.
Easi-Sell operates 7 days per week (excluding public holidays).

Term and Fees

(a) The agreement remains valid for one (1) calendar month from the signing date or until the vehicle is sold, collected, or otherwise removed — whichever occurs first.
(b) The monthly rental fee is payable in advance. No portion is refundable if the vehicle is removed before the end of the month.
(c) The rental will continue monthly until the vehicle is sold or collected.

Vehicle Ownership and Risk

(a) The owner confirms the vehicle is privately owned and not being sold in trade.
(b) The vehicle remains at the owner’s risk while displayed at Easi-Sell. The owner agrees to maintain full insurance, including cover for test drives by potential purchasers.
(c) Easi-Sell and its staff are not liable for any loss, theft, or damage to the vehicle, however caused, including negligence.
(d) The owner authorises Easi-Sell to display vehicle details, photographs, and price information on signage, online listings, and other marketing materials.
(e) The owner authorises Easi-Sell to apply promotional materials (e.g., stickers or number plate surrounds) and to remove any existing advertising.

Online Advertising

Where applicable, Easi-Sell may list the vehicle on selected online platforms (e.g., Trade Me, AutoTrader). Any associated listing or success fees must be paid in advance.
The owner remains responsible for compliance with the Consumer Guarantees Act (CGA) and the Fair Trading Act (FTA). Easi-Sell may recover any costs arising from a claim under these Acts that relate to the vehicle.

Payments and Debt Recovery

(a) The owner authorises Easi-Sell to debit the nominated credit card or bank account for the initial and any subsequent month’s rental fees until the vehicle is sold or collected.
(b) Accounts not paid within 30 days may be referred to a debt recovery agency. A default fee of 25% of the outstanding amount may be charged to cover recovery costs.
(c) Any such default may be reported to a credit reporting agency.

Vehicle Management

If required, Easi-Sell may (at the owner’s cost) replace the vehicle battery or add up to $20 of fuel to enable movement, test drives, or display presentation.

Sale Authority

(a) The owner acknowledges that they remain the legal seller of the vehicle.
(b) Easi-Sell gives no guarantee that the vehicle will sell while displayed.
(c) The owner indemnifies Easi-Sell against all claims, losses, or damages arising from the sale of the vehicle.
